Article 1: General provisions
The electronic web shop of Lockwood, a BVBA with registered office at Ijzerenwaag 1, 2000 Antwerp (Belgium), VAT BE 0479 303 823, RPR Antwerp, (hereafter "Lockwood-Avenue.com") offers its customers the opportunity to purchase online the range of in-store products, including but not limited to shoes, clothing, skateboard hardware & accessories. These Terms & Conditions ("Terms & Conditions") apply to all items in the Lockwood-Avenue.com range and any purchase made by the customer from Lockwood-Avenue.com. The customer accepts that these Conditions, shall be the only ones applicable, to the exclusion of their own general or specific (purchase) conditions, even if they would stipulate that they are the only ones applicable.
Article 2: Price
All prices stated are always inclusive of VAT and all other taxes required to be borne by the customer, unless the customer visits Lockwood-Avenue.com from a country not belonging to the EU member states. During checkout, the customer always sees the costs in the check-out, in which VAT is calculated according to the customer's shipping address. If transport, reservation or administrative costs are charged, this will be stated separately. The indication of price refers exclusively to the articles as described verbatim. The accompanying photo is intended to be decorative and may contain elements or articles not included in the price. Colours may vary slightly from those shown in the photos. All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.
Article 3: Offer
The articles are exclusively intended for normal private use. Despite the fact that the catalogue and website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date.
If You have specific questions about, for example, sizes, colour, availability, delivery time or delivery method, please contact our customer service department in advance (see article 12). Lockwood-Avenue.com is in no case liable in case of material errors, typesetting or printing errors. The offer is always valid while stocks last and may be amended or withdrawn by Lockwood-Avenue.com at any time. Lockwood-Avenue.com is entitled -without giving reasons- to refuse orders, adjust delivery times, split deliveries, or attach other conditions to the delivery.
Article 4: Online purchases
The customer has the option of purchasing items from the Lockwood-Avenue.com range online. The purchase is effected when the customer receives a payment confirmation via email notification from Lockwood-Avenue.com.
Article 5: Retention of title
The delivered items remain the exclusive property of Lockwood-Avenue.com until complete payment by the customer. However, the risk due to loss or damage passes to the customer from delivery. The customer undertakes to draw the attention of third parties to the retention of title of Lockwood-Avenue.com if necessary, for example to any person who would come to seize items that have not yet been paid for in full.
Article 6: Penalties for non-payment
Without prejudice to the exercise of other rights available to Lockwood-Avenue.com, in the event of non-payment or late payment, the customer shall be liable, ipso jure and without formal notice, to interest of 10% per annum on the unpaid amount. In addition, the customer shall be liable, ipso jure and without formal notice, to pay liquidated damages of 10% on the amount concerned, with a minimum of €25 per invoice. Without prejudice to the above, Lockwood-Avenue.com reserves the right to take back items that have not been paid for (in full).
Article 7: Complaints
Any visible damage and/or qualitative deficiency of an article or other shortcoming in the delivery must be reported immediately, under penalty of forfeiting any right.
Article 8: Warranty
a. Legal guarantee (for consumers only)
Under the Act of 21 September 2004 on the protection of consumers when selling consumer goods, consumers have legal rights. Each article is subject to the legal guarantee from the date of purchase by (if applicable, delivery to) the first owner. Any commercial warranty does not affect these rights.
b. General
To invoke the warranty, the customer must be able to produce the proof of purchase. For items purchased online and delivered to the customer's home, the customer must contact Lockwood-Avenue.com customer service in advance after which the customer must return the item to Lockwood-Avenue.com at their expense. Any defect must be reported within 10 days of its discovery. Thereafter, any right to repair or replacement lapses. The (commercial and/or legal) warranty is never applicable to defects arising as a result of accidents, neglect, falls, abnormal or incorrect use, use of the article contrary to purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the article, heavy-handed use, poor maintenance, abnormal or incorrect use. It also does not apply to articles with a shorter lifespan, or wear and tear articles. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless the Customer can prove otherwise. The warranty is not transferable.
Article 9: Term of renunciation
The provisions of this article apply only to customers who purchase items online in their capacity as consumers : The consumer has the right to notify Lockwood-Avenue.com that he renounces the purchase, without payment of any penalty and without giving any reason, within 14 days from the day following the delivery of the product. Customers who wish to exercise the renunciation right must contact Lockwood-Avenue.com customer service within 14 days from delivery and return the goods within 20 days from delivery of the goods at their expense to Lockwood, Ijzerenwaag 1, 2000 Antwerp. Goods with a sale price of 100 Euro or more should be returned to us by courier (DHL, Fedex, etc). Only items in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back. Will not be taken back under any circumstances: - used, soiled, damaged or incomplete items - items whose packaging (or part of it) has been opened - items custom-made for the customer - items that cannot be returned due to their nature

Lockwood-Avenue.com undertakes to use your data only for the execution of the concluded agreement you enter into through your order and to send you non-binding information from Lockwood-Avenue.com. If you would also like to receive information by e-mail, please also provide your e-mail address. We treat your data as confidential information and will never pass it on, rent or sell it to third parties. You may at any time request, correct, change or delete your data that we keep in Lockwood-Avenue.com's customer list and you may refuse to allow Lockwood-Avenue.com to use your data to send you information. The customer is responsible for keeping his log-in data confidential and for the use of his password. Your password is stored encrypted, Lockwood-Avenue.com therefore has no access to your password. Article 11: Infringement of validity - non-observance
If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions. Failure at any time by Lockwood-Avenue.com to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.
Article 12: Cancellation of an order
Once an order has been paid, it cannot be cancelled immediately. The customer must receive and return their purchase at their own expense to Lockwood-Avenue.com with the return address: Lockwood Avenue, Ijzerenwaag 1-5, 2000 Antwerp, Belgium. If deliveries are refused or not collected by the Customer, Lockwood-Avenue.com will deduct the full return costs plus an administration fee of €30 from the amount to be refunded.

Article 13: Discount Codes, Gift Vouchers & Vouchers
Temporary discount codes for promotions and markdowns, are temporarily usable until the date stated with the promotion or until when this promotion ends. Gift vouchers and vouchers have a standard validity of 1 year, unless agreed with our Lockwood-Avenue.com customer service team. Certain exclusive vouchers and gift vouchers have a different validity, when indicated for example in the additional rules/conditions of a Lockwood-Avenue.com launch product/special release product.

Article 15: Modification of conditions
These Terms and Conditions are supplemented by other terms and conditions expressly referred to, and the general terms and conditions of sale of Lockwood-Avenue.com. In case of contradiction, these Terms shall prevail. Lockwood-Avenue.com may amend these Terms at any time without further notice. Any purchase after the amendment, constitutes an acceptance by the customer of these new Terms and Conditions.
Article 16: Proof
The customer accepts that electronic communications and backups may serve as evidence.
Article 17: Applicable law - Competent court
Belgian law shall apply, with the exception of the provisions of international private law on applicable law and the Rome I Regulation on international sales contracts relating to movable property. In the event of any disputes, the courts of Antwerp shall have exclusive jurisdiction.
